Fee Arrangements

We customize compensation arrangements to fit the needs of the client.  We have the ability to be flexible and to design billing arrangements that make sense for a particular client under the particular circumstance.

The majority of our retentions are billed hourly at current billing rates.  Under appropriate circumstances, we will partner with our clients to develop risk-sharing solutions and alternative fee arrangements to help them address some of today’s most pressing business challenges. Alternative fee arrangements can provide greater fee predictability and better value in appropriate matters by focusing on results and efficiency, often without being based directly on the time expended.

We embrace the changes occurring in the legal market and the manner in which our clients do business, and we are prepared to partner with our clients to meet their objectives.

Retainers

Typically, we will require clients deposit an amount with us as a retainer that we hold until the conclusion of the representation.  The amount of the retainer is determined based on the creditworthiness of the client, the expected total fees payable and other considerations.  The amount held in the retainer does not earn interest.

Engagement Letter Agreements

We require that our clients enter into an engagement letter agreement setting forth the terms of the engagement.  We customize our standard form to the particulars of the representation and send it to our clients for review.  Since it is a legally binding agreement, we advise our clients that it is in their best interest to review the engagement letter with other legal counsel to the extent that any aspect of the agreement is not clear or does not make sense to them.  We request that our clients sign these agreements and send them back, but they do provide that if the client does not object to the terms of this engagement agreement and proceeds to accept legal services from any of our attorneys, the client will be considered to have agreed to the terms of the engagement letter agreement.
